Can I Claim Compensation From an Uninsured Driver?

If you are involved in a car accident and the person responsible is uninsured, would you be able to claim compensation?

If the accident happened in the UK (it doesn't really matter if you were just a tourist visiting the country), the short answer is yes. However, the legal system is complex and you should speak to a Personal Injury Solicitor as soon as possible.

Usually if you are involved in a car accident, you would make a claim against the driver responsible for the accident. And his insurance company would make the payment if your claim is successful. However, if the driver is an Uninsured Driver, your solicitor would make the claim with the Motor Insurers' Bureau.

The Motor Insurers' Bureau was set up in 1946 to compensate the victims of drivers without insurance in England and Wales. It is estimated that around one in every twenty drivers on UK roads are without insurance. This record is one of the worst in Western Europe.

The Motor Insurers Bureau is funded by a levy made against all car insurance companies. In reality, this means all insured drivers are paying for claims incurred by uninsured drivers! And this might shock you - it is estimated that each insured driver pays on average, £30 more for their policy to cover this cost. The total cost of Uninsured Drivers' claims was over £350 million in 2006.

If you are involved in an accident with an uninsured driver, you could still claim compensation against the Motor Insurers' Bureau. So contact a specialist solicitor as soon as possible.
